Many Americans are more comfortable imagining that the either the founders and framers or their grandparents' generation were complete morons who granted authority to the state to take whatever it wished from themselves and their posterity than they are contemplating the possibility that they simply misunderstand the true nature of the income tax. This cognitive dissonance holds even in the knowledge that the sole source of support for their beliefs about the tax have been the representations of those who profit from those beliefs (like tax bureaucrats and "tax professionals").

April 12- In 1633, the examination of Galileo by the Inquisition begins.  In 1776, the North Carolina Provincial Congress instructs its delegation to the Continental Congress to vote for independence.  In 1861, Lincoln's provocation of re-supplying Fort Sumter in South Carolina has its intended effect, and the War Between the States begins.  In 1945, FDR dies in office; Vice President Harry Truman takes over.  In 1961, Soviet cosmonaut Yuri Gargarin becomes the first human to visit outer space and to orbit the Earth.  In 1999, Bill Clinton is held in contempt of court for giving intentionally misleading statements in connection with the civil case brought against him by Paula Jones.

It's Grown-Up Time, Part II

“I don’t know what you mean by ‘glory’,” Alice said.

Humpty Dumpty smiled contemptuously. “Of course you don’t-- till I tell you. I meant ‘there’s a nice knock-down argument for you!’”

“But ‘glory’ doesn’t mean ‘a nice knock-down argument’,” Alice objected.

“When I use a word,” Humpty Dumpty said, in rather a scornful tone, “it means just what I choose it to mean-- neither more nor less.”

“The question is,” said Alice, “whether you can make words mean so many different things.”

“The question is,” said Humpty Dumpty, “which is to be master-- that’s all.”

 

SO, IT'S THREE DAYS BEFORE "TAX DAY", 2013.

 

Over the last few months or years the United States (the fed-state, not the USA) has informed us that "due process" means whatever the executive branch says it does, rather than what we have said it does in our fundamental law. The state has similarly claimed that the right of the people to keep and bear arms means what IT says it does, not what WE said it does.

 

The state has asserted an authority to "tax" Americans for not buying a product the state wishes they would, and to launch "pre-emptive" invasions (on our dime) of other countries which not only have never demonstrably aggressed against us but are incapable of meaningfully aggressing against us.

 

Officials of the state have told us we have no right to be left unmolested and unsurveilled by its agents absent credible suspicion of the commission of a crime. They have told us we have no right to homeschool our kids or to buy (or sell) foods we prefer. They have told us we have no right to peacefully withdraw from participation in (and subordination to) a form of government which we have decided is unsatisfactory to our needs and preferences and institute new Government, laying its Foundations on such Principles, and organizing its Powers in such Form, as to us shall seem most likely to effect our Safety and Happiness.

 

In short, the state has claimed despotic authority over the people, and has done so under the pretense of an authority to "interpret" the meaning of our written law. Scornful Humpty-Dumpty to our bewildered Alice, the state declares, "[A] word means just what I choose it to mean..." and expects us to shut up and be ruled accordingly.

 

Such rule is not a "rule of law". It is a rule of law-defiers.

 

THE LAW-DEFIERS COUNT-- INDEED, THEY RELY-- on Alice humbly cooperating, and adopting for her own words pretended meanings found convenient to the fat state's ambitions. The law-defiers count-- indeed, they rely-- on Alice being timid and in the grip of conditioned respect for (or fear of) those in "high places" like Humpty-Dumpty up on his wall.

 

The law-defiers count-- indeed, they rely-- on Alice muttering to herself, "Maybe next year..." yet again.

A Much-Needed Twenty-Eighth Amendment To The United States Constitution

 

HERE'S THE TEXT OF THE AMENDMENT I'M PROPOSING:

"The power of Congress to regulate Commerce with foreign Nations, and among the several States, and with the Indian tribes shall be exercised solely for the purpose and to the effect of ensuring that such commerce is unhindered and unburdened by any restrictions, prohibitions or charges imposed from any quarter or by any authority, other than such tariffs on foreign imports as are elsewhere provided for herein."

The purpose of this amendment is to end the pernicious resort to a misconstruction of the Commerce Clause by Congress and the executive as a pretext for the assumption of vast and never-authorized liberty-destroying powers, such as drug prohibition, abusive “wetlands” regulations, "gun-control" measures and much else. The Commerce Clause was never actually a grant of such powers.

 

Thomas Jefferson, discussing a proposal to create a national bank, expressed the nature of the authority granted by the commerce clause this way:

"...if this was [alleged to be] an exercise of the power of regulating commerce, it would be void, as extending as much to the internal commerce of every State, as to its external. For the power given to Congress by the Constitution does not extend to the internal regulation of the commerce of a State, (that is to say of the commerce between citizen and citizen,) which remain exclusively with its own legislature; but to its external commerce only, that is to say, its commerce with another State, or with foreign nations, or with the Indian tribes."

According to James Madison, the chief architect of the Constitution, the purpose of the clause is "the relief of the States which import and export through other States, from the improper contributions levied on them by the latter"-- in other words, preventing one State from taxing goods passing through it into another.

 

This amendment will simply restore the Commerce Clause to its proper and intended scope—preventing the several states from interfering with the passage of goods and services across their borders to or from the hands of their citizens and residents.

 

PLEASE COPY THE TEXT ABOVE and send it to your US congresscritters (rep and senators). As much as it might be easier to get this pushed forward by the states, the only method by that avenue calls for a Constitutional Convention, not the proposing of a single amendment. The latter is what we want (and we DON'T want the former). Have them tell you what they do toward this purpose, and then you tell me, so I can coordinate their effort with others and push for support nationwide.

For Americans, financial and economic Armageddon might be close at hand. The evidence for this conclusion is the concerted effort by the Federal Reserve and its dependent financial institutions to scare people away from gold and silver by driving down their prices.

When gold prices hit $1,917.50 an ounce on August 23, 2011, a gain of more than $500 an ounce in less than 8 months, capping a rise over a decade from $272 at the end of December 2000, the Federal Reserve panicked. With the US dollar losing value so rapidly compared to the world standard for money, the Federal Reserve’s policy of printing $1 trillion annually in order to support the impaired balance sheets of banks and to finance the federal deficit was placed in danger. Who could believe the dollar’s exchange rate in relation to other currencies when the dollar was collapsing in value in relation to gold and silver.

The Federal Reserve realized that its massive purchase of bonds in order to keep their prices high (and thus interest rates low) was threatened by the dollar’s rapid loss of value in terms of gold and silver. The Federal Reserve was concerned that large holders of US dollars, such as the central banks of China and Japan and the OPEC sovereign investment funds, might join the flight of individual investors away from the US dollar, thus ending in the fall of the dollar’s foreign exchange value and thus decline in US bond and stock prices.

Just Say "No!" To Thugs

 

APRIL 15 IS "TAX DAY", the day by which most Americans will have decided whether to stand for the law, or slink for a lie.

 

Weighing the scales on the side of standing up for the law are self-respect, respect for the law, the well-being of our children, our debt to the sacrifices of our ancestors, control over nearly half of all that most of us sweat for every day of our lives, and our ability to discipline the size and character of the increasingly dangerous, increasingly contemptuous state.

 

On the side of the lie is the delusion harbored by many that by endorsing the fiction of a personal indebtedness to their "public servants" even when there is none, or when they have made no study of the relevant law so as to know whether there is one or not*, the cowed and craven will be "left alone" by the monster which they have thus made stronger, more pervasive, more undisciplined and more contemptuous of them for their latest abject surrender to its unbridled lust.

 

LET'S LOOK AT WHAT "BEING LEFT ALONE" WILL INVOLVE:

  • The loss of 45% or so of the "left alone" person's earnings (a good portion of which will be handed over to special interests who will enjoy the fruits of the earner's labor in his stead, while kicking back a goodly portion of the cream to the political operatives in the way of campaign contributions in order to ensure that the cycle continues to fester and worsen);

  • Financing the continued and increasingly vigorous ministrations of the army of bureaucrats whose well-paid mission in life is to dictate every aspect of the "left alone" person's life, from the way he cuts his grass to the way he raises his children, along with the lawyers, cops and guards who will see to his punishment for any resistance to those dictates;

  • Encouraged and accelerated state evasions of the rule of law in all other areas, including, but not limited to, forcing the "left alone" person to spend what wealth is left to him in the interests of factions who have purchased influence with the political elite (like the "healthcare mandate"); ever greater assaults on personal privacy; the assertion of non-constitutionally-authorized power over American energy consumption ("cap and trade" and other let's-all-get-destitute-together-'cause-otherwise-the-sky-will-fall! "green" shades of lipstick on old socialist tyranny pigs); and the continued erosion of legal protections for those accused by the state of failing to adequately love and obey its commands.

Such a deal!

 

Further, of course, not only is this kind of "being left alone" NOT being left alone at all, but making a false choice of this sort now also means the loss of one more annual opportunity to loosen the rack on which the American heritage of liberty and law has been being systematically broken for decades now. Every person who chooses to go with a lie lends his or her weight to turning the ratchet on that rack past another, tighter notch.

 

ON THE OTHER HAND, every American who says "No!" to lying, and to the thugs whose ambition for control over our lives, fortunes and sacred honor the lies serve, stands with the Founding generation in mature, honorable acceptance of the sometimes-inconvenient reality that Constitutions can't enforce themselves and those whom the law seeks to restrain can't be relied upon to faithfully exercise those restraints over themselves. As Frederick Douglas observed,

 

"Power concedes nothing without a demand. It never did and it never will. Find out just what any people will quietly submit to and you have the exact measure of the injustice and wrong which will be imposed on them, and these will continue till they have been resisted with either words or blows, or with both. The limits of tyrants are prescribed by the endurance of those whom they suppress."

 

Only a deluded fool would think otherwise.

 

THE ADVERSARIES OF THE FOUNDERS' VISION of a free America graced with a strictly limited government hope that everyone is a deluded fool. They hope that even those who have not engaged in taxable activities will bow and submit to their avarice and ambition in order to be "left alone" another year, under the delusion that if and when being "left alone" gets too intolerable, there'll still be time then to stand up and lay down the law, and make everything right.

 

Sadly, that there'll be time to stand up and lay down the law when being "left alone" grows intolerable is a pipe-dream. Every time an American makes the wrong choice the adversaries of the Founders' vision grow stronger and the people grow weaker. As one member of America's greatest generation pointed out when faced with the same choice,

"They tell us, sir, that we are weak; unable to cope with so formidable an adversary. But when shall we be stronger? Will it be the next week, or the next year? Will it be when we are totally disarmed, and when a British guard shall be stationed in every house? Shall we gather strength by irresolution and inaction? Shall we acquire the means of effectual resistance by lying supinely on our backs and hugging the delusive phantom of hope, until our enemies shall have bound us hand and foot? Sir, we are not weak if we make a proper use of those means which the God of nature hath placed in our power. The millions of people, armed in the holy cause of liberty, and in such a country as that which we possess, are invincible by any force which our enemy can send against us. Besides, sir, we shall not fight our battles alone. There is a just God who presides over the destinies of nations, and who will raise up friends to fight our battles for us. The battle, sir, is not to the strong alone; it is to the vigilant, the active, the brave. Besides, sir, we have no election. If we were base enough to desire it, it is now too late to retire from the contest. There is no retreat but in submission and slavery! Our chains are forged! Their clanking may be heard on the plains of Boston! The war is inevitable--and let it come! I repeat it, sir, let it come.

 

It is in vain, sir, to extenuate the matter. Gentlemen may cry, Peace, Peace-- but there is no peace. The war is actually begun! The next gale that sweeps from the north will bring to our ears the clash of resounding arms! Our brethren are already in the field! Why stand we here idle? What is it that gentlemen wish? What would they have? Is life so dear, or peace so sweet, as to be purchased at the price of chains and slavery? Forbid it, Almighty God! I know not what course others may take; but as for me, give me liberty or give me death!"

Sound hokey, and dated, maybe even quaint? Sure. And subjugating a people under some fictional pretense of authority, and commanding them like slaves or serfs, thanks to the successful propagation of myths about "tax amendments", "social contracts" and "collective responsibilities"-- fortified by the subtext that to stand up and say "NO!" is to risk being singled out for "special attention"-- is hokey, dated and quaint, too, because it is the age-old dynamic by which tyrants ply their craft. But that dynamic hasn't gone away, however quaint it may be; and thus Patrick Henry's clear-eyed wisdom and resolution remain just as timely today as they were in 1775.

 

HOW WE GO FROM HERE AND NOW IS IN YOUR HANDS.

 

This great country got where it is now by a series of bad choices, made one by one, person by person, over a century of apathy, delusion, and fear.

 

Its road back to liberty and the rule of law can only be navigated by another series of choices-- good choices, made one by one, person by person, with courage and commitment to the truth.

Are You Ready For More Power?

I wrote this back in 2000 when the "Million Mom March" took place during the last major "gun-control" madness. I'm pleased to re-present a slightly-updated version for continuing service today

 

The Million Mom Moue

 

RECENTLY, ORGANIZERS WHIPPED TO A FROTHY FRENZY by sensationalist hype mobilized an eye-catching host of miffed mothers in the ‘Million Mom March’ on Washington, demanding that the State usurp their children’s birthright of freedom in order, apparently, to spare these women the trouble of seeking out safe schools and day-care centers, or otherwise looking out for their own interests at their own expense.

 

Declining to put forth the effort to equip themselves with facts and stand tall like adults, these hypnotized activists, puffed with media attention and public-school-fed self-esteem, are confident in their effortless, clueless opinion that the existence of guns in private hands is the source of their inconvenience. By God, they’re Mad as Hell, and They’re Not Going to Take It Anymore!!

 

Parroting without scrutiny erroneous and fraudulent special interest claims and cooked statistics about violence in schools, lawlessness in the streets, and the role of guns in history, politics, and modern society, the million Moms stand ready to trade the Second Amendment for a promise of wisdom and benevolence from the same bureaucratic monolith that gave them those shoddy, dangerous public schools and drug-war fueled gangland urban battlefields.

 

This rising up of Oprah’s national audience is both comical and tragic. It is comical that these women imagined themselves to be girding up their loins and bravely marching into the political arena, jaws square and eyes grim to demand action, compelling media coverage in order to pressure recalcitrant lawmakers. The reality was and is that they are the deluded victims of that same media and those same demagogic politicians, both of whom are happy to seize upon such ‘calls to action’ as an opportunity to pander even further to these welcome marks.

 

The tragedy is that these women, willing (or even eager) to live their lives as children, are buying wide-eyed into the well packaged promise that everything will be all right if they just let the nice man into the house... that’s right, take the chain off the door, sweetheart, I’m not going to hurt you... give me the gun... They will make as their lesson and their legacy to those children-- on whose behalf they claim to act-- surrender and prostration before the State.

 

The movie title will be: "Mrs. Smith goes to Washington, listens to some Sweet Nothings, and gets Date-Raped".

 

IF MOM WERE SERIOUS ABOUT THE SAFETY OF HER KIDS IN SCHOOL, in fact if she were concerned about their well-being in general, she would be learning and acting on the truth about the "income tax" so that she or Dad could afford to drop their career and homeschool little Justin and Jennifer. For that matter, if safety was truly the issue she would be cutting up her driver’s license, because FAR more kids are killed in auto accidents than are killed by guns.

 

But both of those real solutions would be inconvenient for today's modern, a-go-go Mom. Better for her to buy her conscience some time by infringing on her neighbor's rights while equipping herself with the comforting fantasy that she’s "taking on the problem."

 

This all puts me in mind of a possible real solution to our real problem: Let's make an oath to uphold and defend the Constitution-- which prohibits gun control-- a requirement every time a voter exercises the franchise.

 

 

P. S. The bright side of this otherwise depressing story is that the MMM activism has stimulated some counter-activism by grown-up women calling themselves the Second Amendment Sisters, whose website can be accessed at www.2asisters.net. I hope all freedom loving ladies will visit them and give some thought to joining them in their defense of liberty.

April 16- In 1862, slavery is outlawed in the District of Columbia-- a year after the start of the War Between the States.  In 1941, Bob Feller throws an opening-day no-hitter for the Cleveland Indians against the Chicago White Sox.  In 1943, Albert Hofmann takes his first trip.  In 1947, approximately 2,300 tons of ammonium nitrate exploded in a cargo ship in the harbor of Texas City, Texas, wreaking enormous destruction.  In 2007, a lone gunman successfully kills or wounds 55 American adults who had been denied the means of self-defense under the policies of Virginia Tech.

If You're Not Standing Up, Then You're Standing Down

..and "standing down" means "going down"

 

MY FRIENDS, IT IS MY SINCERE BELIEF that this community of activists has been encouraged, inspired, enlightened and expanded over the years by the steady posting here of your ongoing victories on behalf of the rule of law. Certainly, it has been my pride and my joy to help you share with the world your honorable testament to the liberating truth about the tax, widespread knowledge of which is so critical to the well-being of ourselves, our children, and our beloved America.

 

However, unless YOU send those victories I can't post them. Unless YOU stand up, your courage and commitment can't inspire anyone.

 

YOU WILL RECALL THAT FOR THE LAST YEAR OR SO I've been telling you that we are in a transformational moment. Look around at what is going on today and recognize the truth of what I say.

 

More than half the American population views the state as a threat. As mainstream a publication as Forbes magazine is posting articles about massive DHS ammunition and armored vehicle purchases.

 

The LA Times, NY Times, Washington Times and other mainstream organs are editorializing about Leviathan having grown too big, and gotten dangerously out-of-hand (see stories at each of the preceding links). Rand Paul's filibuster denouncing the lawlessness of Mordor-on-the-Potomac has prompted a major buzz across the country.

 

Concurrently, this CtC community has been winning legal victories and refunds which are ever-more significant and telling. Consider, for instance, the half-dozen victories won during the last twelve months which qualified for the EWWBL collection (starting with episode 39). Every one of these is an especially illuminating acknowledgement of the truth about the tax, and included in this handful is a very significant two-time victory in a federal district court.

 

Things are happening!

 

HOW IT ALL SHAKES OUT is still up for grabs, though. This is not the time for either complacency or paralysis, because both of those don't amount to "doing nothing"-- instead they amount to "standing down". And standing down means conceding the fight, letting all these eleventh-hour sparks of light burn out unnurtured and the moment be a transformation for the worse.

 

This is not the time for standing down. This is the time for a FULL-COURT PRESS.

 

This is the time for educated American grown-ups to stand up tall and firm, pulling others to their feet by their very gravity. This is the time for leading the way.

About The Author

 

Pete Hendrickson enjoys the distinction of being the first American in history to secure a complete refund of Social Security and Medicare ‘contributions’ withheld from his earnings (along with all other property taken for federal taxes).  He is far from the last, though-- readers of his seminal work, ‘Cracking the Code- The Fascinating Truth About Taxation In America’  and its just-published sequel, 'Was Grandpa Really a Moron?', have been doing the same ever since the book first appeared in 2003.

 

Hendrickson is also a widely-read essayist on matters of politics, public policy and law; many of these works are collected in his second book, ‘Upholding the Law And Other Observations’.  He is a member of Mensa; an award-winning artist; and has paid his dues as a youth soccer coach.  He is a long-time political activist as well, and has served as co-chair and platform convention delegate of Michigan’s largest county Libertarian Party organization; as a consultant to the National Right to Work Foundation and Citizens for a Sound Economy; as a member of the Heartland Institute; and as a member of the International Society for Individual Liberty.  He is a frequent radio-show guest on stations across the country.

 

Hendrickson's business career has included nearly a decade-and-a-half at the leading edge of the renewable-energy industry, both as Director of Purchasing and Materials Management and member of the R&D board at Starpak Energy Systems, the mid-west's then-largest solar heating and energy-recovery-and re-utilization company; and as founder and president of AFJ Inc., a high-efficiency lighting design, manufacture and installation firm.

 

Beginning in the mid-1990s and continuing for the twelve years before his present full-time focus on the restoration of the rule of law in America, Hendrickson directed purchasing activities for the $84 million-a-year multi-family-housing division of the Farmington Hills, Michigan branch of Edward Rose and Sons, with responsibility for 18,000+ apartments, direct supervision of 35 technicians and agents, and incidental authority over several hundred divisional workers.  He also ran the division's 10 cable television earth-station and distribution systems in four states, and designed and administered the company's website.

 

On rather the other end of the spectrum, amidst these more mundane pursuits Hendrickson co-founded and was the primary creative force behind a small board- and card-game company that enjoyed a modest success for several years.

 

 Hendrickson makes his home in southeast Michigan, with his wife and two children.  He is currently working on his next book.
