LAST WEEK I POSTED
MY EXCITED AND DELIGHTED REVIEW of the new film, 'Captain
America: The Winter Soldier', a wonderful security-state
smack-down and basic-principles-of-law uplift. This is the tale
of a fictional American hero who responds to data-mining,
signature-strikes, mass-surveillance and the law-defying
government officers behind them as the evils that they are-- by
destroying the corrupt institutions facilitating their
nauseating, inherently un-American offenses against liberty and
the rule of law.
This week I'm even MORE excited and delighted to
review the NON-fiction tales of REAL American heroes who really
HAVE stood up to say "NO!" to corruption in government.
These real American heroes learned the truth about
the state's very favorite and most lucrative myth, by which
vast amounts of power and wealth have been snookered out of the
hands of the people and into the hands of those pulling the
state's levers since the 1940s (power and wealth by which the
data-mining, signature-striking, mass-surveilling and much, much
more are made possible). These outstanding men and women stand
tall.
For each of these American grown-ups, one, or ten,
or a hundred fewer bricks are available for the prison-cell wall
being built around us all. For each occasion on which these
folks uphold the rule of law against its defilers, America's
proper foundation is restored and strengthened. They are the
"brave" from the song, and they're making the "free" part real
again.
These heroes sometimes act in the very face of a
snarling, angry and resistant bureaucracy. All of them
act with the knowledge that as much as the entire edifice of
state authority does not and cannot dispute the lawfulness of
their actions, the 800-lb. gorilla that past apathy and
ignorance has allowed the state to become really dislikes
their heroic upholding of the law.
JOINING THE RANKS OF THESE OUTSTANDING AMERCIAN
GROWN-UP MEN AND WOMEN TODAY is the first CtC warrior to share a
victory over year 2013. Ross filed early, and just a couple days
ago received (a typically post-dated) acknowledgement from the feds that his normal
non-privileged earnings do not qualify as "income" and are not
subject to the tax. His refund is on its way.
There IS a modest glitch-- Ross made the mistake
discussed
here. The government appears to have chosen to exploit the
error by hanging on to Ross's Social security and Medicare
withholdings for the moment, even while agreeing that Ross
didn't engage in the activity that cause such taxes to arise.
I'm sure that'll be dealt with in due course, such as took place
in
this very similar incident from a few years ago.

I'M GOING TO FOLLOW IN A MOMENT WITH THE HONOR ROLL
ITSELF-- the list of the truly
remarkable handful of these heroes who have had the courage and
generosity to share with me, for sharing with the world, their victories
on behalf of the rule of law. But I want to precede that list
with an admonition.
One of the points I observed about the wonderful
model of heroism in 'Captain America: The Winter Soldier' is how
Steve Rogers' simple moral clarity cuts through the mud of
legalisms, pretexts and rationalizations
by which the corruption he condemns is defended.
Minds weakened by a lifetime of state-worship
conditioning let themselves be bullied into making room for that
mud. The mud gets elevated to the status of "counter-argument"
in those minds, as though whether or not the government is
obliged to obey the Constitution is open for debate, or whether
or not Constitutional limits are subject to "interpretation" by
appointees of the very government actors on which they are
imposed to accommodate what government
actors want to do.
Rogers, true to his heroic role, isn't compromised
by the self-defeating habit of paying respect to such sophistries.
He knows they can be deemed wrong on their faces simply because they support
the violation of principles known to be right.
Nick
Fury, head of
the
'Strategic
Homeland
Intervention,
Enforcement, and
Logistics
Division' proudly tells Rogers
that his spy satellite capability is so good that it can read
the DNA of terrorists before they step out of their
spider-holes, and allows them to be Hellfire-bug-splatted before
causing any harm. Rogers has an instant, confident, raised-eyebrow
rebuke: "I thought the punishment usually came AFTER the
crime..."
Later, when an angry Fury admonishes Rogers to get
with the program, Rogers wastes no time on
internal debate of what he already knows to
be wrong: "Don't count on it." is his flat and immediate reply.
I want to ask each and every one of you reading
these words to apply the same clean and simple intellectual and
spiritual muscularity here. I want you to push out the mud.
YOU SEE, FOR ABOUT 100 YEARS, THERE HAS BEEN A
CAMPAIGN UNDERWAY to spin public understanding of the impetus
behind the Sixteenth Amendment and the meaning and effect of the
amendment itself. The spin has thrown a lot of mud into a lot of
minds.
For instance, we have been invited all our
lives
to imagine that the Sixteenth Amendment
repealed (or "modified")
the apportionment clauses controlling
capitations and other direct taxes in Article 1, sections 2
and 9 of the US Constitution. Renderings of the text of the
Constitution will often have a note associated with the
apportionment clauses that reads something like this "(...but
see the Sixteenth Amendment)". The reader is intended to
conclude that the Sixteenth Amendment has a "but" effect on
those clauses.
In fact, NOT ONE WORD
of the amendment actually says anything of the sort. The Supreme
Court
REPEATEDLY (and unanimously, in
its most focused, comprehensive and heavily-cited dispositive
ruling on the subject) says the amendment does no such
thing-- and even that it CANNOT do any such thing. The Treasury
Department says the amendment does no such thing. NO authority
actually says the amendment does any such thing, and THEY ALL
say it does not.
But you've been invited to imagine the contrary.
That invitation has been made to you so many times that it has
left mud in your mind, and when you are challenged to speak or
share the truth about the tax, the mud obscures the clarity of
your understanding, saps your confidence and intimidates you
into restraint, equivocation or even paralysis and silence.
ANOTHER KIND OF MUD IS THE VARIETY GENERATED BY
TROLLISH AGENTS-PROVOCATEUR,
who actively inject cognitive pot-holes into the minds of the
vulnerable. These folks chiefly peddle two kinds of obscurants.
One of these troll-muds consists of the fact that government
beneficiaries of the mythology about the tax have occasionally
resisted or defied the truth over the ten years since
CtC first
laid it out and revealed itself as the antidote to the myths.
The idea here is to exploit your life-long conditioning to
respect people in government offices and by default to imagine them
to be honest and honorable.
The hope is that the "trust" conditioning has such
a full-nelson on your brain that you will doubt what you see
with your own eyes (the words of the law, the words of the
Supreme Court, and
the government's endlessly-repeated concrete actions).
The
hope is that you are of such a weak mind that you will say to
yourself, "Well, I've studied all the evidence and it's
undisputable. But some attorneys at the DOJ and a couple of
judges didn't hesitate to attack Pete (albeit
with the use of some odd and illegal dodges), and are
attacking his wife (albeit
with the use of some odd and illegal dodges)and the IRS
occasionally resists some folks acting to reclaim their property
(albeit
with the use of some odd and illegal dodges, dozens of
which, interestingly, have
a documented history of collapsing when all is said and done).
So I guess what I just saw with my own eyes isn't really true."
THE OTHER KIND OF TROLL-MUD consists of distracting
nonsense purporting to be "alternate theories" about the nature
or mechanics of the tax. These false notions are injected into
circulation in the
CtC community and among those on the edge
of becoming
CtC-educated in order to undermine your confidence
and your ability to successfully spread the liberating truth.
Years ago I was naive about these injections of
infection. I imagined that most of them were just sincere
misunderstandings born of the interaction of not-so-great
research skills and the complexities of the tax law.
My view of this began to change when I encountered
a blatant fabrication deployed to support one of these
"competing theories", as discussed
here. As the years went by, I began to note the persistent
reappearance of the same ridiculous, plainly incorrect and
long-since rebutted
notions about the tax in regular cycles, as though someone has
marked on his calendar certain scheduled dates on which to send
out an email with the "31 Facts About The Income Tax" or
something touting "Redemption Theory" or "1099-OID".
Every now and then something new will appear (or at
least, something new to me). Just last week I saw an email boost
for what I suppose would want to be called the "Section 83"
argument-- a ludicrous effort to distract the community arguing,
it would seem, that the key to understanding (and being
liberated from) the tax lies in 26 USC § 83. Somehow those
contriving this one overlooked the fact that section 83 didn't
even get added to the body of tax law until 1969, and is
actually only about how compensation in the form of stock is to
be evaluated when measuring the amount of taxable activity it
represents.
Also last week (this stuff has a tendency to flood
the net with special abandon at this time of year) I saw a big
(unsigned) item explaining that the income tax isn't actually
an excise. Instead (we are told), the tax is actually a tariff on foreign-related gains.
This assertion is based on the fact
that... wait for it... the Brushaber court refers to its case as
an effort to enjoin the Union Pacific R.R. from "complying with
the income tax provisions of the tariff act of October 1913".
Wow.
This "tariff" argument also deploys some casual misrepresentation (and related
misconstruction) of some Supreme Court rulings; some strained
discussion of the use of the term "duty" in early income
tax enactments (with a disregard-- or ignorance-- of the fact that
in 1866 Congress specified that its use of the term was to be
understood to just mean "tax"); and a good deal more.
As I mentioned above, at one time I would
have ascribed these errors (and the many others not mentioned
here) to a meeting of poor research skills
with the daunting complexity of the tax law. But the
entire truth about the tax was laid bare in
CtC more than ten
years ago. That ten years has seen thousands and thousands
of government admissions of its correctness-- all unprecedented
in American history, and of the most unambiguous,
deep-evidentiary character.
More,
CtC's body of documentation and historical evidence and authority
has continuously been growing ever since. It is impossible to
continue to believe
these erroneous notions to be sincere mistakes.
On the contrary, all of these servings of mud must
be deliberate, and those serving them out government actors. At
best, the "delivery-men" are useful idiots after the fashion of those
recruited and exploited by the FBI to participate in phony
"domestic terrorist" incidents and keep the masses scared and
the funding-pot boiling-- mushrooms given bogus stuff to deploy
as unknowing tools in service to a government project.
In addition to the anonymous e-mailers, there are the "permanently emplaced" radiators
of this sort of troll-mud. These include sites like "Family
Guardian" (also known as "SEDM"), "Freedom Law School" "Truth
Attack" and the
recently discovered "Weiss Associates", among many others.
Unless these folks are so stubbornly blind that they have to be
hit with a brick to recognize that
CtC is "it", and that the only thing needed
now is 100% solidarity and steadfastness, they are government
operatives or tools. In any event, they have nothing to
offer but mud.
The long and the short of it is that if you
encounter tax-related material by email or on the web which
doesn't advise you to read
CtC as pretty-much the
first thing (or DO get that advice but then subsequently encounter
anything in conflict with, or additional to, what
you have seen in
CtC or 'Was
Grandpa Really a Moron?'), you're dealing with a
knowing or unknowing government-scam-serving affair meant to throw mud in your eyes.
FINALLY, THERE IS THE MUD OF FEAR. This is the mud
that basically comes from inside. It whispers,
"It doesn't matter what's right and
what's not-- doing what the government wishes you wouldn't risks
trouble! Stand down..."
I have very little to say about this last kind of
mud, and even if I wanted to try I couldn't improve on the words
of Sam Adams that have always been the "Last
Word" on this newsletter page since its inception, or those
of Thomas Jefferson that are the very last thing on this
webpage. I will leave commentary on the mud of fear to those
worthy gentlemen.
SO, ALL THIS DIRTY TALK WAS PRELUDE TO ONE SIMPLE
POINT: Heroes arise from within ordinary people once the mud of fear and doubt are washed away.
Today we're going to honor a bunch of these "ordinary" heroes--
America's real-life anti-S.H.I.E.L.D.. These are the real-life wielders
of the
shield the Founders designed for just these times
in the hope that good folks like these would
still grace the land.
I hope all of you will join me in honoring these
men and women. I also hope that you'll share my hope that come the end of this year's
season of truth or lies, there are a whole lot more heroes whose
names can be proudly added to this list.

tax schemes" in different courts across the country in 2004 and

carefully-inaccurate description of a typical
CtC-educated filing was listed
as #1 on the IRS "Dirty Dozen" list in 2006 (reappearing again
as #5 in 2007 and #10 in 2009). Interestingly, in 2008 the Sixth
Circuit Court Of Appeals excused this and similar efforts to
mislead, declaring that the
government can't be prohibited from "SUGGESTING [that
CtC] promotes false or
fraudulent tax schemes"... (emphasis added);

contrived IRS PR-campaign "lawsuit"
against my wife and me in 2006, ostensibly seeking to recover
refunds made to us several years ago-- which even the United
States Treasury Department acknowledges were, and remain,
perfectly proper-- by means of an unprecedented court order
commanding us to replace previously-made sworn testimony with
words dictated by the government declaring our earnings to be of
a taxable variety and to only speak government-approved words in
the future;
...since the IRS launched a vicious
assault on me personally in 2008 in a desperate, deeply
corrupt effort to cow the educated into paralysis and frighten
the ignorant away from the liberating truth, so as to continue
successfully bleeding both into penury and subjugation;
...and since
a criminal action was brought against my wife alleging
non-compliance with DOJ-requested court orders assuming control
of her speech of so obviously-illegal and indefensible a
character that the government resorted to
a jury
instruction for her trial barring consideration of the
lawfulness or Constitutionality of the orders: "It is not a
defense to the crime of contempt that the court order was
unlawful or unconstitutional" in deciding
whether she could be found to have violated an actual legal duty
when resisting them.
DON'T MISS THE MESSAGE! This history-- both
the decade+ of non-stop concrete concessions by governments all
across the land, and the decade+ non-stop effort to suppress

by any means necessary-- exists because

restrain the rogue state that I have told you it is. The state

Look at every other "activist" thing on
which you spend your time. Ask yourself if any even remotely
meets this same standard of hard evidence concerning its
significance. Then push them all aside and
focus your energy on the one
"patriot's task" that has so thoroughly proven its worth.
