while knowing that their beliefs about the tax are derived entirely from
the representations of those who profit from those beliefs (like tax
bureaucrats and "tax professionals")?

A teacher asked
her 6th grade class how many of them were fans of Big Government.
Not really knowing what a Big Government fan is, but wanting to be liked by
the
teacher, all the kids raised their hands except for Little TJ.
The teacher asked Little TJ why he has decided to be different...again.
Little TJ said, "Because I'm not a fan of Big Government."

Illuminating anniversaries of this week:
April 26- In 1607,
English colonists make landfall at Cape Henry, Virginia before
going on to establish Jamestown. In 1865, Confederate General
Joseph Johnson surrenders to Union General William Tecumseh
Sherman near Durham, North Carolina; and John Wilkes Booth is
reportedly found and killed by Union cavalry troops in North
Virginia. In 1933, the Gestapo is established in Germany. In
1982, a South Korean police officer spends eight hours using his
department-issued weapons (and a few others selected from the
police armory) systematically killing 57 civilians-- most in
their homes, but the first three being the local telephone
exchange operators.

Government's Second Bite At Doreen
Many of you will find these of

SOME OF YOU WILL HAVE BEEN AWARE OF THE FACT
THAT MY ATTENTION WAS OCCUPIED over the last few weeks,
resulting in my neglect of some emails. I apologize, but
writing the motions posted below had to take precedence.
Many of you will find these motions and
supporting arguments to be of interest for various reasons.
You will also find it interesting (and more than a little
disgusting) that the government
attorneys actually oppose the motion to have Doreen's
cousin, who was too sick to testify in the first trial, and
who suffers from debilitating, liver failure from which she
could literally die any day without warning, deposed in
order to preserve her testimony.
ANOTHER INTERESTING THING IS THE GOVERNMENT
ATTORNEYS' "counter-motion" filed on a hurry-up basis this
Monday (the last day possible) right after reading our
motion seeking to have US attorneys barred from cell-phone
possession in the re-trial due to their egregious abuse of
the privilege previously. The counter-motion asks for
official permission for the government to use lap-tops in
the courtroom instead...

Giving A Tax-Keynesian A Little
Schooling
FOLKS WHO STILL CLING TO STATIST MYTHOLOGY ABOUT
THE INCOME TAX AND ASSOCIATED LAW are like Keynesians in the
realm of economics. They are seemingly incapable of recognizing
(or admitting) that they were wrong and that the Austrians are
right, no matter how overwhelming the evidence.
Kind of tragicomically, as much as they would
vehemently protest against it, these stubborn statists are also adherents to the
doctrine of "living law". After all, they take as authoritative
of the scope of the tax merely what
the current power structure would like everyone to believe it
is.
The "income tax Keynesians" embrace the latest
power-preferred-belief despite the fact that it is contrary to
what the tax laws actually say and contrary to what the courts
have said about those laws. They embrace the latest
power-preferred-belief even though it's contrary to what those who enacted both the
relevant statutes and the Constitutional provisions to which
they must conform plainly said they meant them to be.
In fact,
when obliged to do so by educated Americans,
even the powers-that-be themselves acknowledge
that the belief they want everyone to harbor about the tax is
untrue, and that
the tax remains just as it was written. But the Keynesians
persist in arguing that the tax has been transformed into what
the powers-that-be simply want people to believe about it. Like
it or not, that's deeming the tax laws to be "living laws."
I IMAGINE THE "INCOME TAX KEYNESIANS" BELIEVE the Fourth Amendment actually
allows for warrantless seizure of
everyone's papers and effects, anytime the state wants them.
After all, it's what the state wants everyone to believe is true about
the amendment's meaning.
These Keynesians must also believe the Second Amendment doesn't reflect
Constitutional respect for non-state-controlled citizen
possession of weapons. After all, the state has long
struggled mightily to get everyone to believe that the amendment
only concerns some kind of state-regulated "group right".
I SUPPOSE THESE "INCOME TAX" KEYNESIANS MUST STILL BE IN A
SORT OF DENIAL/SHOCK MODE over the IRS having given everyone in
the country a "rebate" on
illegally collected "phone taxes" in 2007. After all, the
state had been collecting them for decades, even over the
sustained protest of many Americans.
Those in power had vigorously and persistently
encouraged everyone to believe that those phone taxes were
valid.
Even though the "phone tax" took in a mere pittance, and its
misapplication relied entirely on a 8th-grade-education-obvious
misconstruction of a single word ("and"), it was vigorously
defended in court by the DOJ on behalf of the IRS for years.
By the metric of the "income
tax Keynesians", then, the "phone tax" MUST have been legal.
What the law creating it actually says, or what those who
enacted it meant it to be are irrelevant to its legitimacy.
So when 6 out of 6 federal circuit courts finally admitted eight
years ago
that the decades-old "phone tax" application to
most Americans had actually been CONTRARY to the real meaning
and effect of the law all that time, the tax Keynesians must have in shock. They must have thought,
"The tax had been being collected! The powers that be wanted us
all to believe the tax applied as they were applying it! Why did
these courts even LOOK at the words of the law itself? WE don't!
After all, what do THEY matter?! The meaning of the law is
whatever the current-powers-that-be have convinced everyone to
believe that it is!"
Sadly, the ill effects of that shock persist.
Despite that nice object lesson, these Keynesians can't bring
themselves to shine its light on the "income tax".
Maybe it's because what the powers-that-be want
everyone to believe about the "income tax"-- which DOESN'T bring
in a "mere pittance", and is the #1 statist weapon against
individual self-determination-- is SO much more vigorously
defended than was the misapplied "phone tax". The ubiquitous,
systemic character of the infectious defensive mythology
deployed on behalf of state defiance of the truth about the
income tax is so powerful as to drive even the obvious lesson of
the "phone tax" out of the Keynesians' minds.
ANYWAY,
CtC-EDUCATED SCHOLAR GREG SUTTON has generously made an
effort to shake one of the leading members of the "Keynesian
school of tax pundits"-- Jacob Hornberger (founder and president
of the Future of Freedom Foundation)-- out of his shocked state
and into the sunlight.
Greg's effort is prompted by Hornberger's recent
"tax-day"-timed posts inanely calling for the abolition of the
income tax based on taking the representations of the nature of
the tax by the powers-that-be at face value (and bouncing off
some ill-educated mid-Twentieth-Century writings on the subject
by the otherwise usually very worthwhile essayist Frank Chodorov).
Such abolitionist calls simply support and advance the statist
mythology about the tax, and serve only to fasten its
misapplication ever more tightly on everyone else. They are
completely irresponsible and shamefully un-American.
Greg's admonition against the dark side and his
invitation to Hornberger to step into the light is a
pitch-perfect model of how this kind of effort should be made. I
am pleased to share it with you all, both so that Greg can be
duly appreciated for this excellent work, and so that everyone
else can benefit from this great example of how to proceed with
similar neighborly efforts of their own directed at Hornberger
and other "income tax Keynesians.
Remember, friends don't let friends harbor and
spread dangerous nonsense.

Hi Jacob,
As a long-time libertarian and regular
reader of FFF Daily I'm generally in lock-step with your
knowledge and beliefs within the libertarian/classical
liberal context. But when it comes to the income tax we
are far apart. Very far apart indeed.
Sir, I am no slouch when it comes to
understanding the income tax within the
libertarian/classical liberal context. I have done the
research, spent the necessary time and effort as have
many others who wear the libertarian label. We have
dared to move past Chodorov's clouded view of the tax,
something we urge you to muster the courage to consider.
Quite honestly, we are embarrassed for your ignorance in
this vital-for-freedom subject matter and would like to
facilitate your learning the truth.
For a man learned in the law I am surprised
you didn't pick up on the fact that Chodorov doesn't
discuss the Brushaber or Stanton rulings anywhere in the
book. The Brushaber case was intentionally granted
certiorari by the SCOTUS to settle once and for all the
question of what was the purpose and meaning of the 16th
Amendment.
The recognized understanding at the time
was that the purpose of the amendment was to overturn
the Pollock decision and return to Congress its full
power to tax the incomes of those engaged in the
exercise of federal government privilege. (See the ninth
excise/duty of Blackstone's list.) But a supposed expert
on taxation, Professor of Political Economy at Columbia,
E. R. A. Seligman, a German Historical School educated
socialist and member of the growing class of elite
intellectuals influencing popular opinion through the
"expert" bully-pulpit of intellectual journals very
popular in the late 1800's and early 1900's, in his 1911
tome The Income Tax, had posited the view that the
purpose of the 16th Amendment was to allow a general,
direct income tax without apportionment.
The SCOTUS had earlier recognized a
disagreement with these political economists in Scholey
and in Knowlton as to their understanding of the
distinctions between direct and indirect taxation. This
was again the case in Brushaber. The court ruled
unanimously that Brushaber, and thereby Seligman, had no
idea about what they were talking about.
The ruling reiterated the fact that the
income tax is in the nature of an excise and is enforced
as such. An excise is a privilege tax.
Thus the income tax is a privilege tax on
the exercise of federal government privilege and always
has been and forever will be. That, in a nutshell, is
the income tax within the libertarian/classical liberal
ideological context and the supreme law of the land.
Whereas the source for your and Chodorov's historically
unfounded beliefs is a German educated socialist who had
visions of grandeur as a member of the braintrust of big
intrusive government. No wonder we are embarrassed for
you.
Get up to speed with
this essay.
If I can help in any way to get you over
the hurdle that misinformation, habit and fear have
created in your mind feel free to contact me. There are tens of thousands of Americans,
including myself, who have jumped over that hurdle and
learned the truth about the tax. A man of your
intellect, with a legal education to boot, should have
no trouble with the material, other than it trashes a
life time of miseducation.
It's tough to admit that you've been lied
to your whole life about the income tax especially if
you have been espousing those lies from your hard earned
bully pulpit your whole life too. But once you realize
the uber significance to freedom in general and the
libertarian community specifically the damaged ego will
understand.
I urge you to get on with your new-found knowledge, we need your voice.

Barack Obama Pulls a George W. Bush: Lies,
Misinformation and Chemical Weapons

Am I misjudging our time, or have we entered some
accelerated cycle of American subversions, and then another cycle of
coverups and disinformation that do not quite come off? In less than
a year, the Obama administration has mounted four covert coup
operations, all variants of the classic Cold War model, all costly
of human life, all assuring us the contempt and animosity of many
people for years to come.
In chronological order:
* The American-authorized coup in Egypt last July. In
the disinformation universe, Washington watched at a distance. Since
the coup, dead silence in the face of a blood bath, except for
Secretary of State Kerry’s applause for the Egyptian army’s
“restoration of democracy.”
* In the war to depose Syria’s Bashar al-Assad, the
linchpin event is the chemical-weapons attack last Aug. 21. We are
invited — required, actually — to believe Assad allowed U.N.
inspectors in to determine responsibility for previous gas attacks
and then launched another attack near Damascus while the inspectors
were settled in their hotel rooms.
* The role of the U.S. and its European allies in
financing, fomenting and steering the direction of the Ukraine coup
requires little discussion at this point. Rather bizarrely in the
face of all we have on record, the Obama people continue to insist
Ukraine is nothing more than a case of Russian overreach. As order
unravels in the eastern sections of the country, it is important to
bear in mind the chronology of events — and from the beginning, not
somewhere in the middle.
* In Venezuela, the foreign minister recently read
aloud portions of intercepted cable traffic documenting American
subterfuge. No, no, no: Nicolás Maduro, successor to the late Hugo
Chávez, is just as paranoid as his mentor, and both were merely
trying to distract Venezuelans from their economic problems.
(Vigilance is always essential when Washington and the hacks marshal
the “distraction” thesis.)
Cuba could go on this list, given news of Washington’s
operation of a social-media network on Cuban soil via the customary
collection of front companies, except that intruding covertly in
Cuba is so routine as to be (appallingly) unremarkable.
I find this an exceptionally busy schedule for the
spooks and the nation-building set. We can explore the reasons on
another occasion; for now, it seems also unusual that so much of
what in an earlier time would remain hidden from view is not.

This And That
The Supreme Court sinks a bank-shot; IRS bonuses; Texas
pushback; more...
NOW AND THEN EVEN TODAY'S UNITED STATES SUPREME COURT
GETS ONE RIGHT--even if often not for the right reasons. Tuesday was
such an occasion, as the court overruled a nonsensical Sixth Circuit
Appellate ruling and upheld Michigan's referendum-enacted
constitutional ban on discrimination in public university
admissions, public employment and public contracting.
It's only a shame that the court insisted on clinging
to, and making their ruling against, only the pinched and perverted
Plaintiff's argument that the ban somehow compromises political
access for those who favor discrimination (which they insist on
calling "affirmative action"). Far better would it have been for the
court to have observed that however the Plaintiff chose to construct
and characterize its argument, what it amounted to was a plea in
favor of discrimination, and as such, it had to fail.

TEXAS ATTORNEY GENERAL GREG ABBOTT IS SHOWING US WHAT
OUGHT TO BE everyone's first reaction to anything done by the feds.
A federal Bureau of Land Management (BLM) plan to claim control of a
big chunk of property inside Texas borders has come to light, and
Abbott is properly taking a default position of, "Sorry, I don't
think so...":

 I
hope Abbott sticks to his guns, with that great little bon mot
you see on many a sign along the highway in his fine state: "Don't
mess with Texas." Pushback should be EVERYONE'S default reaction to
Leviathan now. It's a healthy habit for the spirits of free people. *****
DO YOU KNOW WHY THE LIBERATING TRUTH ABOUT THE INCOME
TAX is spreading so slowly, and not being taken up and trumpeted by
the alt-media (at least)? Do you know why that truth is not a big
presence in public consciousness, supporting you in your
conversations on the subject with your friends, family, co-workers,
bosses and professional service-providers?
The reason is that very often when someone first hears
about that truth, the next thing he or she does is go to the
internet and "google"
CtC or me. What comes up in greatest number or most prominence
can strongly influence whether that person moves forward or
backward, and unfortunately, what often comes up most strongly are
DOJ and troll posts rich with disparaging and misleading propaganda
about either subject. The reason this is so is because YOU are not
posting contrary material rebutting the lies and misrepresentations.
If we are all going to get the benefit of this
liberating truth, I cannot be the only voice correcting the record
on the internet about "what the courts have REALLY ruled" in regard
to
CtC. I can't be the only one debunking
the efforts to disparage
CtC by misrepresentations of the
kangaroo-court assaults on me.
Whether the truth wins out here involves a battle of
pens, not swords. YOU HAVE TO BE IN THIS BATTLE, or it may not be
won for years. On the other hand, if you DO get into this battle and
get thoughtful posts up all over the internet designed to address
the specific problem I describe here, it can be won very quickly
indeed. Please do your part.

What Do The People Do About The Rogue State??
The
most important question facing Americans today
I HAD THIS QUESTION POSED TO ME BY AN EMAIL CORRESPONDENT the other
day. I guess this just shows how poor a job I've done at
communicating, because I have been trying to shout the answer to
this one from the rooftops for a long time.
That answer is simple: The People impose restraint on the rogue
state by choosing-- one by one-- to cease voluntarily turning
control over their resources to the state, and choosing instead to
retain control over those resources. This is done by refusing-- one
by one-- to engage in "income tax" excisable activities (and
refusing to blindly or fearfully allow their activities to be
treated or taken as excisable activities upon which the tax arises,
when they really are not).
The refusal of individual Americans to voluntarily engage in
excisable activities forces the state to resort to
highly-politically-accountable, highly-politically-vulnerable
alternatives revenue sources. These include options like direct,
apportioned taxes (which will not be tolerated by the people or
approved by Congress at $multi-trillion annual volumes), and/or
increased revenue tariffs (which can raise amounts adequate for
legitimate state needs, but are very self-regulating, since
consumers naturally choose domestic product alternatives when higher
tariffs raise the prices of imports beyond a certain point).
This solution is precisely the one intended and provided for by the
Founders-- who didn't impose the taxation rules in the US
Constitution just so they could admire their handwriting. They put
those rules in place in direct anticipation of state behavior of the
sort with which we are now plagued.
As even so odious a character as Hamilton pointed out in Federalist
#21:
“Imposts, excises, and, in general, all duties upon articles
of consumption, may be compared to a fluid, which will, in time,
find its level with the means of paying them. The amount to be
contributed by each citizen will in a degree be at his own
option, and can be regulated by an attention to his resources.
...If duties are too high, they lessen the consumption; the
collection is eluded; and the product to the treasury is not so
great as when they are confined within proper and moderate
bounds. This forms a complete barrier against any material
oppression of the citizens by taxes of this class, and is itself
a natural limitation of the power of imposing them.”
What we've got today is simply the direct (and perfectly
predictable) consequences of NOT adhering to the Founders' plan. As
Frederick Douglass trenchantly observed,
“Find out just what any people
will quietly submit to and you have the exact measure of the
injustice and wrong which will be imposed on them."
We've got plenty of injustice and wrong these days. But our fix to
the problem was bought for us with blood a few hundred years ago.
All we have to do is stop playing along with the rogue state's
false (and rather embarrassingly crude) paradigm concerning
who owns what, and what powers to tax have really been granted.
As soon as enough of us quit endorsing that nonsense,
it's all
good.

If You're Not Standing Up, Then You're Standing Down
...and "standing down" means "going down"...
MY FRIENDS, IT IS MY SINCERE BELIEF that this community of
activists has been encouraged, inspired, enlightened and
expanded over the years by the steady posting here of
your ongoing victories on behalf of the rule of law.
Certainly, it has been my pride and my joy to help you share
with the world your honorable testament to the liberating truth
about the tax, widespread knowledge of which is so critical to
the well-being of ourselves, our children, and our beloved
America.
However, unless YOU send those victories I can't post them.
Unless YOU stand up, your courage and commitment can't inspire
anyone.
YOU WILL RECALL THAT FOR THE LAST YEAR OR SO I've been telling
you that we are in a transformational moment. Look around at
what is going on today and recognize the truth of what I say.
More than half the American population views government as a
threat. As mainstream a publication as Forbes magazine is
posting
articles about massive DHS ammunition and armored vehicle
purchases. Denunciations of the NSA violations are features
in every major MSM organ.
Even before Edward Snowden's documentation of particular crimes
being committed against the American people the
LA Times,
NY Times,
Washington Times and other mainstream organs were
editorializing about Leviathan having grown too big, and gotten
dangerously out-of-hand (see stories at each of the preceding
links). In the Spring Rand Paul's filibuster denouncing the
lawlessness of Mordor-on-the-Potomac prompted a major buzz
across the country, and in July Justin Amash shocked Washington
by very nearly defunding a huge portion of the illegal
surveillance state's crimes.
Concurrently, this
CtC community has been winning legal victories and refunds
which are ever-more significant and telling. Consider, for
instance, the victories which have qualified for
the EWWBL collection. Every one of these is an especially
illuminating acknowledgement of the truth about the tax, and now
include a very significant two-time victory in a federal
district court.
Things are happening!
HOW IT ALL SHAKES OUT is still up for grabs, though. This is not
the time for either complacency or paralysis, because both of
those don't amount to "doing nothing"-- instead they amount to
"standing down". And standing down means conceding the fight,
letting all these eleventh-hour sparks of light burn out
unnurtured and the moment be a transformation for the worse.
This is not the time for standing down. This is the time for a
FULL-COURT PRESS.
This is the time for educated American grown-ups to stand up
tall and firm, pulling others to their feet by their very
gravity. This is the time for leading the way.

Illuminating anniversaries of this week:
May 1- In 1328, England recognizes Scotland as
an independent state after 32 years of attempted conquest. In
1931, the Empire State Building in New York City is dedicated.
In 1950, Guam is organized as a "State
of the United States". In 1960, the U2 spyplane piloted by
Francis Gary Powers is shot down over the Soviet Union. In
1971, the National Railroad Passenger Corporation (Amtrak) is
formed. In 2003, George W. Bush declares: "Mission
accomplished!" in Iraq. In 2006, the government of Puerto Rico
closes its Department of Education and 42 other government
agencies in responsible recognition of its fiscal situation. In
2011, Barack Obama announces the assassination of Osama bin
Laden in Abbottabad, Pakistan by a crack team of Navy Seals.
The truth of this assertion is unknown. According to the
official story, although arguably the most potentially-useful
subject of interrogation in US history (at least in the context
of the alleged "terrorist war" paradigm within which all of this
happened), and although described as unarmed and easily-taken,
bin Laden was instead summarily shot in the head. No body was
ever seen; instead it is claimed that the body was taken away by
the SEAL team and then simply dumped at sea. Considerable
evidence exists indicating that bin Laden had actually died
years earlier, in December of 2001; further, the series of
videos purportedly of bin Laden making various pronouncements
useful to the US propaganda campaign supporting its foreign and
domestic policies in the intervening years were obvious fakes.

About The Author
Pete Hendrickson is possibly the
most effective lawyer in history, even while never having
set foot in a law school, nor ever being a card-carrying
member of "the bar". He is the first American in history to
secure a complete refund of Social Security and Medicare
‘contributions’ withheld from his earnings (along with all
other property taken for federal taxes); further, since 2003
students of his legal analyses and arguments in ‘Cracking
the Code- The Fascinating Truth About Taxation In America’
(CtC), and its sequel, 'Was
Grandpa Really a Moron?' have been routinely
retaining and recovering billions of dollars which
otherwise-- wrongly, but as a matter of course-- would have
gone to federal or state government treasuries. This despite
concerted efforts by government to suppress his work,
and in some cases
vigorously oppose the claims by
his students.
Hendrickson is also a widely-read essayist on matters of
politics, public policy and law; many of these works are
collected in his second book, ‘Upholding
the Law And Other Observations’. He is a member of
Mensa; an
award-winning artist; and has paid his dues as a youth
soccer coach. He is a long-time political activist as
well, and has served as co-chair and platform convention
delegate of Michigan’s largest county Libertarian Party
organization; as a consultant to the National Right to Work
Foundation and Citizens for a Sound Economy; as a member of the
Heartland Institute; and as a member of the International
Society for Individual Liberty. He is a frequent
radio-show guest on stations across the country.
Hendrickson's business career has included nearly a
decade-and-a-half at the leading edge of the renewable-energy
industry, both as Director of Purchasing and Materials
Management and member of the R&D board at Starpak Energy
Systems, the mid-west's then-largest solar heating and
energy-recovery-and re-utilization company; and as founder and
president of AFJ Inc., a high-efficiency lighting design,
manufacture and installation firm.
Beginning in the mid-1990s and continuing for the twelve years
before his present full-time focus on the restoration of the
rule of law in America, Hendrickson directed purchasing
activities for the $84 million-a-year multi-family-housing
division of the Farmington Hills, Michigan branch of Edward Rose
and Sons, with responsibility for 18,000+ apartments, direct
supervision of 35 technicians and agents, and incidental
authority over several hundred divisional workers. He also
ran the division's 10 cable television earth-station and
distribution systems in four states, and designed and
administered the company's website.
On
rather the other end of the spectrum, amidst these more mundane
pursuits Hendrickson co-founded and was the primary creative
force behind a small
board- and
card-game company that enjoyed a modest success for several
years.
Hendrickson makes his home in southeast Michigan, with his wife
and two children. He is currently working on his next
book.
