someone who finds it easier to believe that the far-better-educated,
far-more-suspicious-of-government Americans of a hundred years ago were
complete morons who granted authority to the state to take whatever it
wished from themselves and their posterity than to imagine that they
themselves simply misunderstand the true nature of the income tax? Even
while knowing that their beliefs about the tax are derived entirely from
the representations of those who profit from those beliefs (like tax
bureaucrats and "tax professionals")?

Illuminating anniversaries of this week:
August 31- In 1422,
Henry VI becomes King of England at the age of nine months. In
1803, Lewis and Clark start out on their expedition across
America. In 1864, Union General William Tecumseh Sherman begins
the assault on Atlanta that would end with his troops being
ordered to burn the city to the ground. In 1897, Edison patents
the movie projector. In 1939, the Hitler regime stages a
false-flag Polish attack on the Gliewitz Radio Station in order
to justify Germany's intended invasion of Poland.

Every Which Way But Loose
A bizarre effort to evade an educated filing, and
some nice normal victories for the rule of law.
SO, HERE'S A QUESTION FOR YOU: If you didn't
receive any "income"-- and the IRS has agreed you did not, in
writing ("Adjusted gross income- Your Calculations: $0.00; IRS
Calculations: $0.00. Taxable income- Your Calculations: $0.00;
IRS Calculations: $0.00"), can the government still keep money
that had been withheld from you and put into its hot and sweaty
hands against the possibility you might be one of those
"ignorance tax-payers"? The IRS wants Karen Stobbe to just say
okay to this and go away...
LAST APRIL, Karen filed a routine, educated
rebuttal of "wage"-receipt allegations and concurrent claim for
the return of money that had been withheld from her pay against
the possibility she might engage in a taxable activity during
2013 and end up owing a tax.
Her return showed no "income", and claimed the return of
$6,207.80 that had been diverted from her pay as "Federal income
tax withheld", Social security tax withheld" and "Medicare tax
withheld".
However, rather than simply getting her refund of
these "overpayments",
as most do, Karen was treated to a little resistance. This
took the form of an IRS "LTR
12C", on which the IRS claimed to "need more information to
process [Karen's] return accurately". The letter goes on to say
that the agency wants something more from Karen supporting her
claim of $6,207.80 withheld.
Of course, Karen had already provided a
properly-completed and signed IRS Form 4852 supporting her
claim. Therefore, she wrote
a polite letter in response to the "LTR 12C" pointing this
out, while also offering to send the form again upon request.
Karen also suggested that the agency refer to its
own records for the copy of the erroneous W-2 which her Form
4852 had rebutted and on which the withheld amounts are
reported, or that it contact the creator of that W-2 for another
copy if necessary, ending with, "If you need further
clarification, or if I miscomprehend your request, please let me
know soonest."
Here is the agency's reply (with some "contact" and
duplicate header material cropped off):
SO... Everyone agrees that Karen had no
"income" and owes no tax. The service has no evidence disputing
Karen's claim of $6207.80 withheld-- to which she has sworn
under penalties of perjury.
Further, the IRS either has (and surely does), or
can readily get, confirmation of the amounts withheld from the
company that did the withholding. But instead of returning
property to which it has admitted it has no claim, it just
hunkers down and implies that it is going to burden Karen with
the trouble and expense of suing.
I fear the folk in this agency are not America's
finest... I hope Karen has a better draw when she pursues this
with someone a little higher up in the agency.
P. S. Did you notice the dual column "your
calculations/IRS calculations" in the "income" and "tax" part of
this notice, and the absence of the "your calculations" column
in the "payments and credits" part? An interesting omission.
ON A HAPPIER NOTE...
Let me also share with you this week two much more
typical responses by the government to
CtC-educated
filings. Both of these were recently received by (a different)
K. S.-- these are the third and fourth victories for K. and her
husband over the last year or so:
You'll notice that both of these victories resulted
from amended returns correcting older pre-CtC-education filings;
please also note that the first issued just three weeks
before
my wife Doreen's kangaroo gang-bang, and the other two weeks
after that elaborate government effort to convince all of
you that this "CtC"
stuff is all just wrong and bad.

Say WHAT?!
"Because revenue agents are responsible for conducting
civil tax audits, it was entirely proper for government counsel to refer
to [RA Heidi Beukema's] activities in that manner."
BELIEVE IT OR NOT, THIS IS HOW US ATTORNEY MELISSA
SISKIND tries to justify her deliberate misrepresentations in
Doreen's trial. Attempting to falsely impeach Doreen's testimony
of the previous day, Siskind described
failed civil actions targeting me for an injunction ten years
ago as being nothing but efforts to conduct an audit.
Siskind "reasons" that her false assertions about
the actions were ok, since it was a revenue agent who initiated
the injunction effort, and revenue agents do audits. This
despite the fact that in its own filings in the actions the DOJ
described them as meant to determine "whether [Hendrickson] can
be enjoined..."
What a great standard to use for choosing the most
honest way of saying something! I guess that if Siskind were an
accountant and embezzled from her client, she'd just call it
"bookkeeping", 'cause, you know, that what accountants do...
This corrupt rationalization is actually offered over Siskind's
signature in the "government response" to the motion Doreen
filed three weeks ago seeking to have her engineered contempt
conviction of last month overturned.
HERE'S ANOTHER CHALLENGE TO THE SENSIBILITIES from
Siskind's response:
"Clearly, nothing the defendant was ever told by a
court or a government agency was going to cause her to change
her mind. As the government argued in closing: that is not good
faith. That is willfulness."
Gotta love that one... According to Siskind,
holding firmly to your own considered and settled views, and
refusing to subordinate them to what Siskind suggests are
contrary opinions of certain government officials is
"willfulness"; and subordinating your views to
these supposedly contrary opinions of certain government
officials is "good faith". I think she's got
this backwards...
Of course, Siskind never actually produced any
"official opinions" contrary to Doreen's view that she was under
no legal obligation to adopt government-dictated words as her
own testimony. All Siskind could produce was Nancy Edmunds'
corrupt orders themselves and two appellate rulings-- one which
doesn't even pretend to address the question, and one which
engages in an evasion.
Nor could Siskind produce any "official opinions" contrary to
Doreen's view that her returns are perfectly correct.
What was produced as the supposedly contrary
"official positions" on the correctness of Doreen's returns were
merely an unsigned, self-declaredly-not-official IRS
"examination report" concerning Doreen's and my earnings in 2002
and 2003; "findings" of disputed "facts" (including everything
said on that
unsigned, informal "examination report") by a
district court judge who held no hearings; and an appellate
court ruling that assumed these "facts" to have been properly
found, and just signed off on the district court fiction in an
"opinion" the court not only declined to publish but refused to
publish even after the DOJ asked it to do so (all of which is
detailed and documented
here and
here, if you're interested). It was due to this lack of
actual evidence on this "willfulness" element and all the others
that the government had to resort to fraud.
AS I'VE OBSERVED BEFORE: CORRUPTION, LIKE RUST,
never sleeps. Siskind doubtless stayed up late producing her
mendacious "response" to Doreen's pending
motion to vacate her kangaroo conviction. Siskind has
something personal at stake, of course, since that fraud she
argues wasn't really a fraud was committed by her personally.
Anyway, that
response was filed last week;
the reply went in Thursday.
Groan through the one, if you can stomach it; but
do give the other a good read. (Hey, we were only allowed to go
seven pages with this one, so it's short as well as sharp.)

A teacher asked
her 6th grade class how many of them were fans of Big Government.
Not really knowing what a Big Government fan is, but wanting to be liked by
the
teacher, all the kids raised their hands except for Little TJ.
The teacher asked Little TJ why he has decided to be different...again.
Little TJ said, "Because I'm not a fan of Big Government."
The teacher asked, "Why aren't you a fan of Big Government?"
Little TJ said, "Because I'm a libertarian."
The teacher asked him why he's a libertarian. Little TJ answered, "Well,

America’s spanker-in-chief is at it again—threatening
to bomb Syria owing to the uncivilized actions of its inhabitants.
And when it comes to Syria, Washington avers that there are
punishable malefactors virtually everywhere within its borders.
Exactly one year ago Obama proposed to take Bashar Al
Assad to the woodshed because he had allegedly unleashed a
vicious chemical attack on his own citizens. That was all pretext,
of course, because even the CIA refused to sign-off on the
flimsy case for Assad’s culpability at the time—-a reluctance
corroborated since then by the considerable evidence that hundreds
of Syrian civilians were murdered during a false flag operation
staged by the rebels with help from Turkey. The aim of the
rebels, of course, was to activate American tomahawk missiles and
bombers in behalf of “regime change”, which was also the stated goal
of the Obama Administration.
Now the White House is threatening to bomb Syria again,
but this time its “regime change” objective has been expanded to
include both sides! In 12 short months what had been
the allegedly heroic Sunni opposition to the “brutal rule” of the
Assad/Alawite minority has transmuted into the “greatest terrorist
threat ever”, according to the Secretary of Defense.
So Obama has already unleashed the drones and
surveillance apparatus to identify targets of attack that will help
bring down a regime in northern and eastern Syria—the
so-called Islamic State—which did not even exist a year ago. And a
regime that is now armed to the teeth with America’s own latest and
greatest weaponry as previously supplied to the disintegrated Iraqi
army and the Syrian rebels trained by the CIA in Jordan.

This And That
The biggest hypocrite of the week; videocams on cops,
but let's not stop there; more...
ON THURSDAY, BARACK OBAMA SAID RUSSIA must face
consequences for the terrible act of training, arming and funding
separatists in Eastern Ukraine. Unbelievable.
Obama and his war-mongering cabal must really think the
American people are asleep, if not comatose. Do they think we don't
know who had been-- or still is--
training, arming and funding separatists in Syria, Iraq, Libya,
Iran and maybe Chechnya?
For that matter, do
they think we don't know who
trained, armed and funded the plotters of the coup in Ukraine that
created the separatists that Russia may (and by all rights
ought to) be helping take charge of their own circumstances in the
face of the despotism in Kiev?
And yet they presume to condemn Russia for what little it may be
doing to help the victims of the Washington-engineered coup protect
and care for themselves. The
hypocrisy is mind-blowing.

VIDEO CAMERAS ON EVERY COP! This solution,
powerfully-resisted by every bad cop and welcomed by every good one,
is simple, obvious, and should be implemented
right now.
The recordings should be kept in suspension except when
an incident is known to have occurred, and/or when either someone is
charged or an allegation of police misconduct is made. Then out it
all comes for the use of both sides in the controversy. Tampering
with, blocking or disabling the cameras should be a felony.
While we're at it, let's also start cashiering and
barring from future service any cop who shoots, tases or beats
anyone without just cause (meaning, any cop over whose actions any
award is paid). Let's cashier any cop proven to have ever abused
anyone.
Let's cashier any cop who busts down the wrong door.
And let's be rid of police unions, whose major purpose seems to have
become covering up for bad cops, just as the teachers unions do for
their clients. (h/t Glenn Harlan Reynolds, Conor Friedersdorf and
Scott Tillman for some of these notions.)
Easy-peasey. But short of perfect.
LET'S ALSO PUT CAMERAS on all judges and prosecutors,
with the feed reviewable at the demand of anyone dealing with
either. I want anyone in a controversy to be able to see all the ex
parte communications; see who's really reading the briefs (or not);
who's writing the rulings (and who's not); and see what lies are
being told to the grand juries. Do I have a second?

SPEAKING OF THE PEOPLE SUPERVISING THEIR SERVANTS, have you ever given any thought to
what will happen when 30 million other Americans-- or even just 3
million-- learn what you
know about the "income" tax and begin following your example of
acting to protect your own interests and uphold the law?
Leviathan thinks about it-- a lot.

add vigorous outreach to your activism.

What Do The People Do About The Rogue State??
The
most important question facing Americans today
I HAD THIS QUESTION POSED TO ME BY AN EMAIL CORRESPONDENT the other
day. I guess this just shows how poor a job I've done at
communicating, because I have been trying to shout the answer to
this one from the rooftops for a long time.
That answer is simple: The People impose restraint on the rogue
state by choosing-- one by one-- to cease voluntarily turning
control over their resources to the state, and choosing instead to
retain control over those resources. This is done by refusing-- one
by one-- to engage in "income tax" excisable activities (and
refusing to blindly or fearfully allow their activities to be
treated or taken as excisable activities upon which the tax arises,
when they really are not).
The refusal of individual Americans to voluntarily engage in
excisable activities forces the state to resort to
highly-politically-accountable, highly-politically-vulnerable
alternatives revenue sources. These include options like direct,
apportioned taxes (which will not be tolerated by the people or
approved by Congress at $multi-trillion annual volumes), and/or
increased revenue tariffs (which can raise amounts adequate for
legitimate state needs, but are very self-regulating, since
consumers naturally choose domestic product alternatives when higher
tariffs raise the prices of imports beyond a certain point).
This solution is precisely the one intended and provided for by the
Founders-- who didn't impose the taxation rules in the US
Constitution just so they could admire their handwriting. They put
those rules in place in direct anticipation of state behavior of the
sort with which we are now plagued.
As even so odious a character as Hamilton pointed out in Federalist
#21:
“Imposts, excises, and, in general, all duties upon articles
of consumption, may be compared to a fluid, which will, in time,
find its level with the means of paying them. The amount to be
contributed by each citizen will in a degree be at his own
option, and can be regulated by an attention to his resources.
...If duties are too high, they lessen the consumption; the
collection is eluded; and the product to the treasury is not so
great as when they are confined within proper and moderate
bounds. This forms a complete barrier against any material
oppression of the citizens by taxes of this class, and is itself
a natural limitation of the power of imposing them.”
What we've got today is simply the direct (and perfectly
predictable) consequences of NOT adhering to the Founders' plan. As
Frederick Douglass trenchantly observed,
“Find out just what any people
will quietly submit to and you have the exact measure of the
injustice and wrong which will be imposed on them."
We've got plenty of injustice and wrong these days. But our fix to
the problem was bought for us with blood a few hundred years ago.
All we have to do is stop playing along with the rogue state's
false (and rather embarrassingly crude) paradigm concerning
who owns what, and what powers to tax have really been granted.
As soon as enough of us quit endorsing that nonsense,
it's all
good.

has shared another fine outreach effort. Tom has been writing and

If You're Not Standing Up, Then You're Standing Down
...and "standing down" means "going down"...
MY FRIENDS, IT IS MY SINCERE BELIEF that this community of
activists has been encouraged, inspired, enlightened and
expanded over the years by the steady posting here of
your ongoing victories on behalf of the rule of law.
Certainly, it has been my pride and my joy to help you share
with the world your honorable testament to the liberating truth
about the tax, widespread knowledge of which is so critical to
the well-being of ourselves, our children, and our beloved
America.
However, unless YOU send those victories I can't post them.
Unless YOU stand up, your courage and commitment can't inspire
anyone.
YOU WILL RECALL THAT FOR THE LAST YEAR OR SO I've been telling
you that we are in a transformational moment. Look around at
what is going on today and recognize the truth of what I say.
More than half the American population views government as a
threat. As mainstream a publication as Forbes magazine is
posting
articles about massive DHS ammunition and armored vehicle
purchases. Denunciations of the NSA violations are features
in every major MSM organ.
Even before Edward Snowden's documentation of particular crimes
being committed against the American people the
LA Times,
NY Times,
Washington Times and other mainstream organs were
editorializing about Leviathan having grown too big, and gotten
dangerously out-of-hand (see stories at each of the preceding
links). In the Spring Rand Paul's filibuster denouncing the
lawlessness of Mordor-on-the-Potomac prompted a major buzz
across the country, and in July Justin Amash shocked Washington
by very nearly defunding a huge portion of the illegal
surveillance state's crimes.
Concurrently, this
CtC community has been winning legal victories and refunds
which are ever-more significant and telling. Consider, for
instance, the victories which have qualified for
the EWWBL collection. Every one of these is an especially
illuminating acknowledgement of the truth about the tax, and now
include a very significant two-time victory in a federal
district court.
Things are happening!
HOW IT ALL SHAKES OUT is still up for grabs, though. This is not
the time for either complacency or paralysis, because both of
those don't amount to "doing nothing"-- instead they amount to
"standing down". And standing down means conceding the fight,
letting all these eleventh-hour sparks of light burn out
unnurtured and the moment be a transformation for the worse.
This is not the time for standing down. This is the time for a
FULL-COURT PRESS.
This is the time for educated American grown-ups to stand up
tall and firm, pulling others to their feet by their very
gravity. This is the time for leading the way.

About The Author
Pete Hendrickson is possibly the
most effective lawyer in history, even while never having
set foot in a law school, nor ever being a card-carrying
member of "the bar". He is the first American in history to
secure a complete refund of Social Security and Medicare
‘contributions’ withheld from his earnings (along with all
other property taken for federal taxes); further, since 2003
students of his legal analyses and arguments in ‘Cracking
the Code- The Fascinating Truth About Taxation In America’
(CtC), and its sequel, 'Was
Grandpa Really a Moron?' have been routinely
retaining and recovering billions of dollars which
otherwise-- wrongly, but as a matter of course-- would have
gone to federal or state government treasuries. This despite
concerted efforts by government to suppress his work,
and in some cases
vigorously oppose the claims by
his students.
Hendrickson is also a widely-read essayist on matters of
politics, public policy and law; many of these works are
collected in his second book, ‘Upholding
the Law And Other Observations’. He is a member of
Mensa; an
award-winning artist; and has paid his dues as a youth
soccer coach. He is a long-time political activist as
well, and has served as co-chair and platform convention
delegate of Michigan’s largest county Libertarian Party
organization; as a consultant to the National Right to Work
Foundation and Citizens for a Sound Economy; as a member of the
Heartland Institute; and as a member of the International
Society for Individual Liberty. He is a frequent
radio-show guest on stations across the country.
Hendrickson's business career has included nearly a
decade-and-a-half at the leading edge of the renewable-energy
industry, both as Director of Purchasing and Materials
Management and member of the R&D board at Starpak Energy
Systems, the mid-west's then-largest solar heating and
energy-recovery-and re-utilization company; and as founder and
president of AFJ Inc., a high-efficiency lighting design,
manufacture and installation firm.
Beginning in the mid-1990s and continuing for the twelve years
before his present full-time focus on the restoration of the
rule of law in America, Hendrickson directed purchasing
activities for the $84 million-a-year multi-family-housing
division of the Farmington Hills, Michigan branch of Edward Rose
and Sons, with responsibility for 18,000+ apartments, direct
supervision of 35 technicians and agents, and incidental
authority over several hundred divisional workers. He also
ran the division's 10 cable television earth-station and
distribution systems in four states, and designed and
administered the company's website.
On
rather the other end of the spectrum, amidst these more mundane
pursuits Hendrickson co-founded and was the primary creative
force behind a small
board- and
card-game company that enjoyed a modest success for several
years.
Hendrickson makes his home in southeast Michigan, with his wife
and two children. He is currently working on his next
book.
